Public Hearing to Amend Zoning Ordinance #34 & Subdivision Ordinance #29

posted on 7/10/24

The Des Moines County Board of Supervisors will hold a series of public hearings in the public meeting room at the Des Moines County Courthouse on Tuesday, July 23, 2024 at 9:00 AM, Tuesday, July 30, 2024 at 9:00 AM, and Tuesday, August 6, 2024 at 9:00 A.M.  These hearings will address two proposed amendments to the Des Moines County Subdivision Ordinance (Ordinance No. 29), and the Des Moines County Zoning Ordinance (Ordinance No. 34), and which were adopted on February 22, 2022:

  • In Article V of Ordinance No. 29, (“Final Plat”), Section C(1) would be amended to read as follows: “Minor Subdivisions shall be exempt from the requirement to be reviewed by the Zoning Commission.” This section previously referenced the waiving of ‘CSR provisions’, which was a requirement from an earlier version of the ordinance that was replaced in 2022. However, the reference to CSR (corn suitability rating) was left in the current version of the ordinance by mistake, and it became obsolete as a result.
  • In Article II, Division 20 of Ordinance No. 34 (“A-1 Agricultural District”), Section H(1) would be amended to read as follows: “For all Permitted Principal Uses, the minimum front and rear setbacks shall be thirty (30) feet, and the minimum side setback shall be fifteen (15) feet.” The current requirement is 40 feet for the front and rear setbacks, and 25 feet for the side setback.
  • In Article VII, Division 125 of Ordinance No. 34 (“Board of Adjustment”), the opening passage of Section F would be amended to read as follows: “The Board of Adjustment shall have the authority to review and decide on an application for a Variance from one or more of the specific requirements of this Ordinance.” The ordinance currently references the Board of Supervisors instead of the Board of Adjustment, and this was the result of a typographical error.
